One year after losing their 14-year-old son, Brett Gardner and his wife Jessica have filed a lawsuit against Arenas Del Mar Beachfront & Rainforest Resort.
They claim their son Miller died on March 21, 2025, from carbon monoxide poisoning caused by unsafe conditions at the resort. The lawsuit alleges toxic fumes from a poorly ventilated water heater leaked into their rooms, making the entire family severely ill.
Brett, Jessica, and their older son Hunter all suffered serious symptoms, while Miller tragically did not survive. An autopsy later confirmed carbon monoxide poisoning as the cause of death.
The family is now seeking damages for negligence, wrongful death, and emotional distress, saying the tragedy could have been prevented and hoping to raise awareness to protect others.
