Melissa Gilbert became emotional in a New Mexico courtroom as a judge ruled that her husband, actor and director Timothy Busfield, 68, would be released before trial under strict conditions.
Judge David Murphy granted Busfield release on his own recognizance, citing that he had not violated any laws, but placed him under supervision by pretrial services. Busfield must avoid alcohol, drugs, firearms, contact with alleged victims and their families, and have no interaction with children under 18. He was also ordered not to discuss the case with witnesses and to keep the court updated on his address. No trial date has been set.
Prosecutors opposed his release, arguing Busfield had a history of inappropriate behavior and delayed turning himself in after an arrest warrant was issued. They also referenced a past allegation from actress Claudia Christian. Despite these concerns, the judge allowed his release under supervision.
Ahead of the hearing, Busfield underwent a psychosexual evaluation requested by his legal team. The evaluation, which included corroboration from Gilbert, categorized him as “very low risk,” citing his cooperation, employment history, family support, and community involvement.
Gilbert submitted emotional letters defending her husband, describing him as her partner, protector, and a man guided by strong moral values. She pleaded with the judge to take care of him, saying her inability to protect him was “breaking her heart.”
Busfield is charged with two counts of criminal sexual contact of a minor under 13 and one count of child abuse, tied to allegations involving twin boys on the set of The Cleaning Lady. He has denied all allegations and insists he will fight the charges. If convicted, he could face up to 15 years in prison.
